Court suspends appointment of Juan Carlos Florián as Minister of Equality

The Administrative Court of Cundinamarca ordered the provisional suspension of Juan Carlos Florián's appointment as Minister of Equality and Equity. The measure responds to a lawsuit alleging possible disqualification in his appointment as head of the portfolio.

Florián, a representative in the House of Representatives for the department of Meta, was recently appointed to head the Ministry of Equality. His appointment sparked public debate and legal action for alleged noncompliance with the Quota Law, which regulates the participation of women in senior executive positions.

In his defense, Florián identified himself as gender fluid and asked to be addressed as "minister," requesting to be referred to as "minister." He argued that he cannot be classified within the male-female binary for gender quota purposes, which is a central part of his legal strategy before the court.

As part of the evidence, the official submitted personal messages in which he refers to himself as feminine and stated that his identity does not fit traditional categories. The case opens a debate on how gender parity standards are applied to trans and non-binary identities in public administration.

The suspension is a precautionary measure that does not imply permanent dismissal, but freezes the effects of the appointment until the court rules on the legality of the process.
