On September 25, 2025, the Superior Court of Bogotá, Labor Chamber, ruled in favor of a tutela (protection) lawsuit filed by Gustavo Bolívar and Carolina Corcho, representing the rank and file of the Historic Pact. The lawsuit sought to guarantee democratic participation within the movement.

The decision suspends the effects of Resolution 09673 of September 17, 2025, of the National Electoral Council and orders the Registry to immediately open the registration of pre-candidates for the internal referendum scheduled for October 26, 2025.

The ruling establishes the measure as a precautionary measure to avoid irreparable harm and ensure the right to equality in political competition. This will allow the members of the Historic Pact to present candidates on equal terms.

The National Political Committee of the Historic Pact announced that a vote to determine the order of the congressional lists will be held in October, while the presidential pre-candidacy will be decided in March 2026 within an interparty consultation within the Broad Front.

The outcome of the protection represents a step forward for grassroots participation in internal processes and sets a precedent in the defense of political rights within the movement.
